Immigration is the foundation of our nation, and it continues to play an important role. Family-based immigration, however, is complex, and if you’re facing an issue or concern, it can directly affect your family’s future. If this is the challenging situation you find yourself in, it’s time to consult with an experienced Cicero family immigration lawyer

Immigration through One’s Family

The most common method of immigrating to the United States is through one’s family. If you are a citizen or a lawful permanent resident (LPR) of the U.S., you can sponsor certain family members for what is called Green Card status, which affords them permanent residence. This is a straightforward track toward immigration, but it’s also legally challenging.

Once you reach green card status, citizenship generally becomes far more accessible and can be achieved through the naturalization process.

When it comes to family member eligibility, the laws are strict, and only the following meet them:

  • The spouse of a U.S. citizen or LPR
  • The unmarried children – who are under the age of 21 – of a U.S. citizen or LPR
  • The parents of a U.S. citizen or LPR who is at least 21 years old
  • Orphans who are adopted by a U.S. citizen or LPR

This application does not extend to more remote relatives, such as aunts or uncles, grandparents, or in-laws.

The Steps Toward Family Immigration

The family immigration process is exacting and includes all the following preliminary steps:

  • To begin, the relative who is doing the sponsoring must be at least 18 years old – or, in some instances, must be at least 21 years old.
  • The sponsor gets the process started by filing a petition for the sponsored family member with the U.S. Citizenship and Immigration Services (USCIS).
  • This petition is the sponsor’s opportunity to demonstrate that the sponsored relative meets the eligibility requirements and that they – the sponsor – meet the financial requirements to become a sponsor.
  • Along with the petition, the sponsor must establish their commitment to supporting their relative financially by including a signed affidavit of support.
  • At this point, the candidate for family immigration is put through a battery of security and background checks that include health, national security, and criminal screenings.

While the process is complex, successful results are exceptionally rewarding, which makes working closely with a seasoned family immigration lawyer to your advantage.
