  • The parents of a U.S. citizen or LPR who is at least 21 years old
  • Orphans who are adopted by a U.S. citizen or LPR

This application does not extend to more remote relatives, such as aunts or uncles, grandparents, or in-laws. 

The Steps Toward Family Immigration

The family immigration process is exacting and includes all the following preliminary steps:

  • To begin, the relative who is doing the sponsoring must be at least 18 years old – or, in some instances, must be at least 21 years old. 
  • The sponsor gets the process started by filing a petition for the sponsored family member with the U.S. Citizenship and Immigration Services (USCIS). 
  • This petition is the sponsor’s opportunity to demonstrate that the sponsored relative meets the eligibility requirements and that they – the sponsor – meet the financial requirements to become a sponsor. 
  • Along with the petition, the sponsor must establish their commitment to supporting their relative financially by including a signed affidavit of support.  
  • At this point, the candidate for family immigration is put through a battery of security and background checks that include health, national security, and criminal screenings.
