Prior to joining MMH, he was a partner at Carpenter &amp; Capt, Chtd. He\u00a0frequently\u00a0defends foreign nationals in <a href=\"https:\/\/www.mmhpc.com\/es\/immigration-law\/removal-defense\/\">removal proceedings<\/a>, focusing on <a href=\"https:\/\/www.mmhpc.com\/es\/immigration-law\/azyl-i-pomoc-humanitarna\/\">asylum<\/a>, withholding of removal and Convention Against Torture Relief, cancellation of removal and <a href=\"https:\/\/www.mmhpc.com\/es\/immigration-law\/consular-processing-and-adjustment-of-status\/\">adjustment of status<\/a>.\u00a0He has\u00a0won numerous cases before the Board of Immigration Appeals (BIA) and regularly challenges\u00a0USCIS decision and inaction in federal\u00a0court, including through mandamus actions addressing unreasonable agency delays and\u00a0Administrative Procedure Act (APA) actions for\u00a0unfair applications of the law by the government.\u00a0Robert has also successfully litigated no bond detentions in many different states.\u00a0 He has litigated with frequency in the U.S. Court of Appeals for the\u00a0Second,\u00a0Fourth, Sixth, Seventh, and Ninth Circuits; in the last five years, he\u00a0handled dozens of appeals in the Ninth Circuit, gaining multiple remands for asylum seekers.\u00a0Notably, Robert prevailed in the precedent-setting decision of\u00a0<em>Ming Wei Chen v. Sessions<\/em>, 864 F.3d 536 (7th Cir. 2017), where the Seventh Circuit Court of Appeals concluded that a conviction for possession with intent to distribute more than 30 grams but less than 500 grams of marijuana in Illinois, in violation of 720 ILCS \u00a7 550\/5(d), does not categorically constitute a drug-trafficking aggravated felony.<\/p>\n<p>Robert takes pride in\u00a0his\u00a0own\u00a0family\u00a0history. The first of his forbearers\u00a0came to Chicago from Ireland in the late 1840s and\u00a0immediately established\u00a0themselves as leaders in human rights and racial integration.\u00a0 Robert\u00a0humbly and\u00a0proudly continues that family\u00a0tradition by\u00a0passionately\u00a0protecting human rights for all people, and by acting as a\u00a0fierce advocate to ensure the\u00a0rule of law is followed by the United States government.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Robert\u00a0has been an immigration litigator for over thirty years.
