Robert has been an immigration litigator for over thirty years. Prior to joining MMH, he was a partner at Carpenter & Capt, Chtd. He frequently defends foreign nationals in removal proceedings, focusing on asylum, withholding of removal and Convention Against Torture Relief, cancellation of removal and adjustment of status. He has won numerous cases before the Board of Immigration Appeals (BIA) and regularly challenges USCIS decision and inaction in federal court, including through mandamus actions addressing unreasonable agency delays and Administrative Procedure Act (APA) actions for unfair applications of the law by the government. Robert has also successfully litigated no bond detentions in many different states. He has litigated with frequency in the U.S. Court of Appeals for the Second, Fourth, Sixth, Seventh, and Ninth Circuits; in the last five years, he handled dozens of appeals in the Ninth Circuit, gaining multiple remands for asylum seekers. Notably, Robert prevailed in the precedent-setting decision of Ming Wei Chen v. Sessions, 864 F.3d 536 (7th Cir. 2017), where the Seventh Circuit Court of Appeals concluded that a conviction for possession with intent to distribute more than 30 grams but less than 500 grams of marijuana in Illinois, in violation of 720 ILCS § 550/5(d), does not categorically constitute a drug-trafficking aggravated felony.
Robert takes pride in his own family history. The first of his forbearers came to Chicago from Ireland in the late 1840s and immediately established themselves as leaders in human rights and racial integration. Robert humbly and proudly continues that family tradition by passionately protecting human rights for all people, and by acting as a fierce advocate to ensure the rule of law is followed by the United States government.
