Ukraine TPS Automatically Extended Through April 19, 2027

Ukraine’s Temporary Protected Status (TPS) designation was scheduled to expire on October 19, 2026. Before that date, the Department of Homeland Security was required to review Ukraine’s designation and publish a notice announcing whether TPS would be extended, terminated, or redesignated. 

The review deadline was August 20, 2026. As of that date, DHS did not publish a notice regarding Ukraine TPS. Because no announcement was made, the designation automatically extends for an additional six months. The new expiration date is April 19, 2027. 

This extension applies to individuals who already have Ukraine TPS and remain eligible. It does not create a new TPS designation or make individuals who entered the United States after August 16, 2023 eligible to apply. 

Importantly, DHS cannot issue a later notice that simply shortens this automatic extension and ends Ukraine TPS before April 19, 2027. If DHS later decides to terminate the designation, the termination must follow the required notice period and cannot take effect before the end of the current extension period. Under the termination regulation, TPS ends on the later of 60 days after publication of the termination notice or the last day of the most recent extension.  

Current TPS beneficiaries should continue to carry their approval notices and employment authorization documents. USCIS should issue additional guidance explaining how the automatic extension will be documented for employment authorization and Form I-9 purposes. 

For now, Ukraine TPS remains in effect through April 19, 2027. DHS may later decide whether to extend the designation again or terminate it after that date.
