USCIS Extends Deadlines for Response to Requests for Evidence and Notices of Intent to Deny

In response to the Covid-19 Pandemic, USCIS announced a new measure today regarding Requests for Evidence (RFE) and Notices of Intent to Deny (NOID). For applicants and petitioners who receive an RFE or NOID dated between March 1 and May 1, 2020, any responses submitted within 60 calendar days after the response deadline set forth in the RFE or NOID will be considered by USCIS before any action is taken. This means a response may be submitted up to 60 days after the due date listed on the RFE or NOID. It is important to note that this measure only relates to RFE’s or NOID’s issued on or after March 1, 2020, and up to May 1, 2020. Therefore, if you received an RFE or NOID dated before March 1, 2020, your original due date remains in effect.
